Small Fine, Big Restitution For Iris Vandals

Will Poris and Gideon Korn-Wyatt, two Montclair 19 year olds, faced Judge Booker in municipal court yesterday pleading guilty to disorderly persons charges in connection with last year's Iris-cide at the Presby Memorial Iris Gardens. They each face $500 fines, $35 in court costs, and were ordered to write letters to the press, to publicly apologise for their actions. Booker also imposed 30 day suspended jail terms, and the teens agreed to pay $17,000 in restitution for damage they caused to the landmark gardens. The original charge of criminal mischief was downgraded; as a result, the teens won't have a criminal record. A third defendant, 19 year old Daniel Goldmeier, had his case dismissed. And what about hours of community service? The Star Ledger reports:

Booker wanted to give them more, specifically community service. "It's somewhat disturbing, but I'm confined by this statute," he said.

The lesser charge falls under a municipal ordinance, one Booker said lacks a sentencing option for community service, something he said he's been requesting from Montclair's elected officials for years.

Hmmn, something to bring up at the next town council meeting?

Once again proving that the more sense a suggestion makes, the less likely Montclair's "elected officials" are to act on it.

Maybe if the MEDC sponsored it, or if we hired a couple of consultants for $100K, that would help?

The iris frenzy was fueled by alcohol. Underage drinking is a huge problem in this town -- That's where the focus should be. The police should enforce the law and charge teens as well as the parents who condone drinking and provide alcohol at their children's parties or leave their children unsupervised in empty houses.
Teen drinking may be a time honored rite of passage but it's not legal and it can be dangerous.

I'm curious if the lad who had his case dismissed has to share in the restitution. Or does he just walk entirely? And why was his case dismissed?

I also hope Baristanet will be given that "public apology" to run after the boys (or their parental ghost writers) submit it.

So their total fine (excluding cost of restitution) matches what's paid to whomever ratted them out. Interesting wind-up, but not exactly a "resolution" after all the comments here.

Coughing up $17,500.00 isn't exactly skating, though giving them neither jail time nor community service seem a bit flaccid. I hope their parents make them earn the dough themselves rather than covering it for them. And who knows, maybe they'll both volunteer to work in the gardens just out of the true penitence in their hearts. How bout it, Will and Gid, you stupid stoners - up for a noble gesture?

Last time I checked, our justice system operates on proof and not speculation/probability. Did the police collect evidence of intoxication? Did they perform breathalizers and/or field tests on the suspects? If none of this was done on the night of the crime, then the suspects cannot be linked with such public heresay (even if "true").

I am also interested in the reason the third boy was not charged. Anyone have any solid info to share?

Lets clarify this ... the suspects were 19 yrs old which qualifies them as adults, legally separate from their parents, so even if these suspects were drinking in their parent's home from their parent's bar stock, the parents would not be liable due to their adult status ... however, minors (17 yrs and younger) who do the same would make a case for parent liability ...

But Jim, the people on this website live to speculate and make assumptions. If they can't draw conclusions based on hearsay and he said she said, then they will have nothing to say at all and this website will go belly up. They had to have been drinking because somebody said so!

Jim, if you read the article the one man admitted that they "drank alot" that night. I think that removes the speculation that alcohol fueled the incident.

Why would the parents not be liable? I thought that the legal drinking age was 21, so even if they were "adults" at age 19, they were still under age drinkers.

I have no solid info at all, but here is some utterly unfounded speculation: Dan was the one who turned in the Gid and Will - knew about it all along and kept his mouth shut, but once the money was dangled dropped the dime. So the cops go nab Gid and Will. Gid and Will, knowing Dan is the only guy who could have fingered them, retaliate by telling the cops Dan was there too. Dan gets busted as well, lots of public embarrassment, but then eventually the truth shakes out, and after being threatened w/ further prosecution for giving false evidence, Will and Gid recant their statements about Dan. Sounds plausible, right?

Worthy Democratic Presidential Candidates? I had the opportunity to hear Mark Warner speak the other night in Bergen County and I must say i was very impressed. It's very early to speculate on anybody besides Hillary and Richardson, but I think Warner is going to make things interesting.

It was interesting, "good" speculation. Certainly puts an end to some high school friendships, however, if it's true, sleepysleek.

From a judicial point of view, the prosecution must present proof of evidence. If a suspect admits guilt to a media reporter/interview, the judge must decide if that alone is enough to prove guilt. Usually with first time offenders, leniency is offered in hopes the whole experience will deter any further criminal decisionmaking.

And they were not 19 at the time of the incident -- And the drinking age is 21 in this state for some pretty good reasons.
So If I allow your 18 year old daughter/cousin/sister to drink at my house and she gets in a car accident or ends up in a West New York dumpster because she was too intoxicated to exercise good judgment -- It's okay with you? She's a separate legal entity?

And, just for the record, I've raised two kids in this town -- I know what goes on when some parents are home and when they are not. Trust me, teen drinking is a problem in this town. That was my point -- not whether these particular kids should have been charged with illegal drinking.

That alcohol was involved in this case was a fact that Baristanet reported in their original post about this a few weeks ago. I think that report was the first to mention of drinking being involved.

Patsyanne - serving alcohol to minors / persons under 21 other than your own children is illegal in NJ. The parents who permitted it violated the law.

Paul - Thanks. That's what I thought. The problem is that the law is, to my knowledge, rarely/never enforced in Montclair.

$17,000 (8,500 per person) is a lot of money.

This would not feel like "skating" to me. At $10.00 per hour, it will take each person a year of work to pay the the $8.500. A year of working with time off to eat, sleep and watch TV - with no money or time left over for anything else - and lost time working exclusively for someone else - while things like school or working for one's own gain are put on hold for a year. Sure sounds like jail to me. This sounds like a harsh penalty.

This is a ton of money for parents to pay also. I would not want to secure a home equity loan, then throw it away and be left with $250 payments for five years. It would be much better spent on a college semester. I would set restitution at $2,000 each - which seems realistically harsh.

Wouldn't it be nice if everyone just did the right thing all the time? So much time would then not be wasted.

Well, maybe you should talk to the folks at the Iris Gardens and see if they concur. Ask them how much it will cost to replace the bulbs/plants (many of them are gone forever, however), the labor involved to do so, and possibly, the installation of some sort of security system.

Restitution is, by definition, not a penalty at all.

If I lose control of my car and crash it into your house, whether I did something illegal or not, I would have to pay to repair your house. The money I pay is supposed to be based on how much it will cost to fix the house, or how much what I damaged was worth, not on why I lost control of the car (If I was doing something illegal, I might also get hit with fines or other penalties, but that is a separate consideration) or my ability to pay.

In this case, restitution is probably an estimate of the damage that was done to the Iris Gardens. If anything, the figure seems low, but some things are difficult to put a monetary value on.

I was hoping to have some fresh meat. if only they parents did not have $17 large at hand I would have had two rich white spoiled mens to make my into my girlfriends.

First of all, KIDS DO STUPID THINGS. and though these "kids" were 18 a year ago when the iris garden was vandalized, that makes them "legal" adults, but as any parent of an 18 year old boy knows... mostly they are still KIDS. Did anyone say the parents served alcohol to these underaged kids? No. A lot of kids drink, and their parents don't know. Doesn't mean they are bad parents or even bad kids. It happens. It's wrong. There should be consequences, and in this case there are consequences. I think the interests of justice for the Presby is indeed served in this case by the boys making restitution. As for speculating who "dropped a dime" - that's a very dangerous game to play, and it's irresponsible. Anyone who thinks their kid could never be involved in a wrong-doing, better wake up and realize that this is a case of there but for the grace of God. Eventually they all do something stupid as teenagers, to greater and lesser degrees than this, and some get caught and some don't -- but none of our kids are immune to this kind of stupidity.

When my son heard the names of the 3 involved he expresses shock that Daniel G. was involved. "A really nice kid" I was told. However, the involvement of the other 2 did not surprise him at all. As for underage drinking, my thoughts following. Kids drink, deal with it. You probably drank too or your brother or sister did. Your parents too. And trust me, they did not wait until they were 21. The problem is not the drinking, although done to excess it most certainly is as are most things. The real issue is that since it is "illegal" no one wants or dares to teach how to do it responsibly. when I was a kid it was a test of manhood to kill flowers when drunk. I myself mashed a bunch of tulips at the age of 14 after a pint of Southern Comfort. By the time I was 18 I had graduated to JD and gerbera daisies. I say stompin' posies is what separates the men from the boys.

I was referring to the statements regarding how the hypocrits are saying that drinking is wrong at age 18 or so. It's a crock and something that should not be tolerated. It's not wrong at all. What's wrong is that these young adults are not being taught how to drink and act responsibly. They are drinking and smoking pot. Fact. They are good kids, fact. Their parents smoke and drink, fact. They can get sent off to war and they can vote, fact. They get taught how to deal with life, fiction. Many decades ago in Montclair a friend's mother (wife of a doctor)used to buy us a case of beer after school virtually every day. We watched American Bandstand and Million Dollar Movies and madeout with our girlfriends in his basement. We never destroyed any flowers.Two of the couples eventually got married (both lasted for two decades). I virtually stopped drinking in my mid 20s for nearly 25 years so I could function at a higher level at work and set an example for my kids. My son drank in high school. Now in his twenties drinks rarely.

Yes, there is the respect for others property, community property and laws.

Punishment, including restitution should be meted out. It serves as a lesson learned by the individuals in question and as a symbol to the community as a whole as to what is done when adults cross the line into crime. And believe me, it was a crime!

As to getting a group together - that's for the parents and children of the community to decide what's needed.

Bloomfield is building a BMX and Skate Park - that's what the community feels will help.

Montclair has decided that a Skate Park is not of interest and that they would rather move the ball field at the cost of $850,000. The community (or rather the town council and BOE) have spoken.

Montclair would rather that their youth hang out down at the local gas station and be chased or moved by the police for loitering than put together a teen center and program.

Space for a rec center (including a gym) could be created from some of the large projects that are being discussed such as the 100 unit condo building at the former FORD dealership.

In the meantime the Iris destroyers must pay!

You don't just have a few beers and think--yes lets go golfing in the venerated Iris Garden it'll be loads of fun.

At least in Montclair they'll be able to find the Art Museum and the shopping district once the $750,000 Wayfinding project is completed.

Of Course, the Wayfinding project is much more important than a rec center or someplace that kids can gather and stay out of trouble.

Actually, I am curious to know why our Baristaville teens (especially the males) are so ANGRY these days!
