Campaign Signs Make A Comeback

The people spoke up for their First Amendment rights, and Montclair listened. So people, can we have a new show of political predilection? Joe Hartnett writes that enforcement of the local ordinance - which limits how long a campaign sign can stay on your lawn - has been suspended.

To All Who Have Written Regarding Political Signs:

Many have written to question the Montclair ordinance that has been on the books for many years regarding political signs. As a result, our Township Attorney has redoubled his efforts to thoroughly research this issue. Here's what seems to be the case so far:

1. The right to regulate the size of signs in residential zones has been upheld by the courts.
2. There are no cases in New Jersey that have issued a final legal determination on the subject of whether the duration of how long a political sign can be put out can be regulated. However, research so far would indicate that in cases outside NJ it has been determined that the duration of political signs cannot be regulated.
3. As a result of #2 above, we have suspended enforcement of our ordinance as it pertains to the length of time a political sign can be out.

As Township Attorney Trembulak completes his extensive research on this, we will keep you advised. It appears that we are headed to a repeal of certain provisions of the township ordinance that is currently on the books.

I'd like to thank everyone who has contacted us and raised community awareness on this issue. Our own knowledge on this subject continues to evolve.

shhh...
Son't anyone tell our town officials or attorney, but........you can't suspend enforcement of a town ordinance..no more than the state can suspend the enforcement of a state statute...Perhaps no one will realize, that you can't do this. But then again, Montclair has a lot of smart people, who probably already know.

So the question becomes, why didn't Trembulak do his homework the FIRST time around and inform the council correctly? Why did it require residents of Montclair to do Trembulak's job for him? And how much are we paying him for this?

I believe that we are paying Trembulak $100,000 per year to do very little. At the very least he should pay those who have done his research for their time and expertise, without them, he would be lost. And, no, he did not know this before residents brought this to their attention. Shame on them, shame on them all, for forcing the residents of Montclair to do what they get paid to do.

I have to say, under the guise of protecting us from ourselves or not offending someone, this has become one of the most uptight, regulated, stick in the mud free countries in the world. One of the prime examples being restrictive covenants such as homeowner associations. Just because we are densely populated is no reason for this uniformity drive, the dummying down of public eccentricity.
My sister lived in a place in Virginia where your rural type mail box had to be "This", if you put a bovine decorated box out you were fined and they would remove it and bill you for replacing it. I'm not saying there isn't a reasonable you "go too far", it just seems everything is to far PC these days and no good will come from it.
There were people in Montclair who brought action against a neighbor for their natural wild flower landscaping, another didn't like the color the house was painted.
So now it's how long a political sign is on your property, well if you let your property deteriorate to the point of "derelict", somebody should step in; you start presidential primaries two years before the election, why can't I put up my choice on my property?
