
The people spoke up for their First Amendment rights, and Montclair listened. So people, can we have a new show of political predilection? Joe Hartnett writes that enforcement of the local ordinance - which limits how long a campaign sign can stay on your lawn - has been suspended.
To All Who Have Written Regarding Political Signs:Many have written to question the Montclair ordinance that has been on the books for many years regarding political signs. As a result, our Township Attorney has redoubled his efforts to thoroughly research this issue. Here's what seems to be the case so far:
1. The right to regulate the size of signs in residential zones has been upheld by the courts.
2. There are no cases in New Jersey that have issued a final legal determination on the subject of whether the duration of how long a political sign can be put out can be regulated. However, research so far would indicate that in cases outside NJ it has been determined that the duration of political signs cannot be regulated.
3. As a result of #2 above, we have suspended enforcement of our ordinance as it pertains to the length of time a political sign can be out.
As Township Attorney Trembulak completes his extensive research on this, we will keep you advised. It appears that we are headed to a repeal of certain provisions of the township ordinance that is currently on the books.I'd like to thank everyone who has contacted us and raised community awareness on this issue. Our own knowledge on this subject continues to evolve.
