NJ Senate Expands Family Care Leave

A bill that will give New Jersey employees six weeks of paid sick leave to care for family members is expected to be signed by Governor Corzine next week, and become effective Jan. 1, 2009. From The New York Times:

After an unusually emotional debate bursting with political indignation and personal anguish, the State Senate narrowly approved legislation Monday that would make New Jersey the third state in the nation to give employees the right to take paid leave to care for a newborn or a sick relative.

The measure would be financed by employee payroll deductions that would cost every worker in New Jersey a maximum of 64 cents a week, or $33 a year. Those taking the leave would be eligible for two-thirds of their salary, up to a maximum of $524 a week, for six weeks.

...The bill says companies with more than 50 employees must give the workers their jobs back when they return, but makes no such provision for workers at smaller companies.

I thought this was covered under the NJ Family Leave Act? And if not what is the difference between the old and the new?

Or is the answer simply - since everything in NJ is so perfect, taxes are low, everyone has health care and jobs and paychecks fall from trees that our governor has time to re-invent the wheel?

That is not paid, this is.

That did not raise your payroll taxes, this does.

It is hard to be more specific as there have been quite a few revisions of this, and I'm not sure what the final version will look like.

Thank you Carl. So all of us will be paying for a right only a few of us will use? And employers will have to pay people for not being at their jobs? Does this seem like a good way to chase business out of state and add to taxes for social programs to anyone else?

I heard on the news that first an employee would have to use up all his or her vacation and sick time, which would go towards the six weeks. I assume many full time employees get at least two weeks vacation and a week of sick time, so this would only add 3 more weeks.

So if you had the flu and already returned from the islands, you?re good to go for six weeks, or would the employer have to kick in next years benefits first? (what if you change jobs before next year?) Doesn't sound equitable or feasible.

Do I have to prove sickness? My Mom currently has to flu, and I could use a few days off to ski, could I take it now?

This is just one more socialistic move by a true blue socialistic state government. They ahve never met a way to throw away (or even steal) our money that they didn't like.

At what point can I fire them? After the six weeks or when they ask for the six weeks?

Intersting, I seem to recall I got short term disabiltiy during my NJ family leave (due to pregnancy) Is this just saying that now the employer has to pay that instead of the state?

Not sure what the difference is to the employee though?

Girl,

This is in addition to that, SDI covers you, this covers others in your family that you might want to care for. In the case of the newborn, you could get this after your SDI, and the baby's father could get it too.

The NY Times article (linked above) covers it pretty well.

Of course, some companies already do something like this, but now it is mandatory, and being paid for by an additional tax on everyone's paycheck.
